OFFICIAL GENERAL CONTEST RULES

By participating in a contest on Kissin 92.5, KSYN and/or its website (https://kissin925.com) entrants agree to the specific rules, terms and conditions provided for that particular contest as stated, either in addition to or in place of the Official General Contest Rules given here. When specific contest rules differ from these General Contest Rules, the specific contest rules will control.

ELIGIBILITY AND ODDS OF WINNING:

No purchase is necessary to enter or win. A purchase will not improve an entrant’s chances of winning.

Unless otherwise specified in the rules for a particular contest, contests are open to legal residents of the United States who are 18 years of age or older and who reside in Jasper, Newton, McDonald, Barton, Vernon, Lawrence, Barry and Dade counties in Missouri; Cherokee, Crawford, Bourbon, Neosho and Labette counties in Kansas; and Ottawa, Craig and Delaware counties in Oklahoma. Contests are not available to users located in the European Economic Area.

Employees of KSYN, Zimmer Radio, Inc., its affiliates, subsidiaries and successor companies, contest sponsors, advertising and promotion agencies, contest prize suppliers, participating advertisers, and members of their immediate families or households are not eligible to participate. “Immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, including relationships created through marriage, remarriage, adoption, cohabitation, or similar familial relationships. Persons residing in the same household as an otherwise ineligible person are also ineligible, whether related or not.

If a specific contest permits minors to participate, a parent or legal guardian must execute any required release or other documentation on behalf of the minor before a prize may be awarded. KSYN reserves the right to refuse to award a prize to or on behalf of a minor.

Odds of winning depend upon the number of eligible entries received and the method used to determine the winner unless otherwise stated in the specific contest rules.

HOW TO ENTER:

The method of entry for each contest will be announced on-air, online, through promotional materials, or in the specific contest rules. Depending upon the contest, entries may be accepted by telephone, postal mail, email, KSYN’s website (https://kissin925.com), an authorized mobile or digital platform, a social media platform, or at an authorized on-site entry location.

Entrants must provide all information required for the particular contest. Incomplete, inaccurate, fraudulent, illegible, or otherwise invalid entries may be disqualified. Unless otherwise stated, all entries and entry materials become the property of KSYN and will not be returned. Only entries submitted through methods authorized by KSYN will be eligible.

BROADCAST AND STREAMING DELAYS:

Contests heard through KSYN’s Internet stream, mobile application, smart speaker, HD channel, FM translator, or other digital or rebroadcast platform may be delayed from the originating over-the-air broadcast signal. Listeners participating through a delayed platform may therefore be at a disadvantage in contests requiring an immediate response to an on-air announcement, cue, keyword, song, sound, or other event. KSYN and Zimmer Radio, Inc. are not responsible for delays associated with streaming, digital, HD, translator, Internet, mobile, or other transmission platforms.

TELEPHONE ENTRIES:

If a contest accepts telephone entries, KSYN, Zimmer Radio, Inc. and contest sponsors are not responsible for an entrant’s inability to complete a telephone call because of busy signals, equipment malfunctions, disconnections, telecommunications failures, misdialed numbers, service interruptions, or other circumstances beyond their control. Only calls received through the telephone number designated for the contest will be eligible. If a caller is disconnected or determined to be ineligible, KSYN may proceed to the next eligible caller. When a contest requires a selected entrant to hear their name announced and contact KSYN within a specified period, only the actual selected entrant may claim the prize, and the entrant must contact KSYN using the method and within the time period announced.

ONLINE ENTRIES:

For contests accepting online entries, entrants must accurately complete all required fields. KSYN, Zimmer Radio, Inc. and contest sponsors are not responsible for Internet outages, website malfunctions, platform failures, transmission errors, lost or delayed entries, software or hardware failures, or other technical problems that prevent or delay an entry.

Online contests may require entrants to answer questions or trivia, submit a keyword or code word, make a prediction or guess, submit photographs, videos, essays, audio, or other original content, or complete another action described in the specific contest rules.

Where offered, entrants may have an opportunity to separately opt in to KSYN or sponsor email, text messaging, membership, rewards, or promotional programs. Any such opt-in is subject to the terms presented at the time of entry. Some contests may offer additional entries for eligible referrals, sharing activity, or other actions. Any limits and requirements for additional entries will be stated in the specific contest rules.

KEYWORD AND CODE WORD CONTESTS:

When a contest requires a keyword or code word, entrants must obtain the designated word or code and submit it through the method and within the time period announced by KSYN. Entries containing an incorrect, incomplete, or untimely keyword or code word may be disqualified. KSYN is not responsible for an entrant’s failure to hear or receive a keyword because of signal reception, streaming delays, equipment failure, Internet connection problems, or other circumstances beyond KSYN’s control.

SOCIAL MEDIA CONTESTS:

When a contest is conducted through a social media platform such as Facebook, Instagram, X, TikTok, or another third-party platform, entrants must comply with KSYN’s instructions, the specific contest rules, and the applicable platform’s terms and policies. Where a contest requires a designated hashtag, account, photograph, video, comment, tag, follow, or other content or action, the entry must contain all required elements to be eligible. Unless expressly stated otherwise, KSYN contests are not sponsored, endorsed, administered by, or associated with the applicable social media platform. Entrants release the applicable social media platform from responsibility or liability arising from the administration of a KSYN contest to the extent permitted by law.

ON-SITE AND ENTRY BOX CONTESTS:

When a contest requires an entry at a specific event or location, entries must be received at the designated location by the announced deadline. When an official entry form is required, only authorized entry forms will be accepted. Entrants must legibly provide all required information; failure to provide required information may result in disqualification. Mechanical reproductions, duplicate entries, or other methods of entry may be prohibited when specified by KSYN.

ENTRY AND WINNING RESTRICTIONS:

Unless otherwise specified in the specific contest rules, entries are limited to one entry per person, there may be only one winner per household, and a listener may win or qualify to win a KSYN contest only once every thirty (30) days. KSYN reserves the right to extend the thirty-day restriction for the duration of a particular contest or promotion. Void where prohibited by law. All applicable federal, state, and local laws and regulations apply.

CONTEST ADMINISTRATION:

KSYN reserves the right to cancel, suspend, terminate, extend, postpone, or modify a contest if the contest cannot be completed as planned because of technical failures, tampering, unauthorized intervention, fraud, weather, emergency conditions, acts beyond KSYN’s control, or other circumstances affecting the integrity, fairness, security, or administration of the contest. KSYN reserves the right to correct administrative, printing, programming, or operational errors associated with a contest. Decisions of KSYN regarding eligibility, entry, winner selection, interpretation of rules, and administration of a contest are final.

LIMITATION OF LIABILITY AND RELEASE:

KSYN, Zimmer Radio, Inc., their subsidiaries, affiliates, officers, directors, employees, agents, insurers, shareholders, representatives, advertising and promotional agencies, and contest sponsors assume no responsibility or liability for loss, injury, death, or damage arising from participation in a contest or the acceptance, possession, use, or misuse of a prize, to the fullest extent permitted by law.

By participating in a contest, entrants release and agree not to bring claims against KSYN, Zimmer Radio, Inc., their subsidiaries, affiliates, partners, related entities, directors, officers, employees, agents, insurers, attorneys, shareholders, representatives, predecessors, successors, assigns, advertising and promotion agencies, contest sponsors, and prize suppliers for claims, losses, damages, expenses, costs, or liabilities arising from or related to participation in the contest or acceptance, possession, use, or misuse of a prize, to the fullest extent permitted by law.

PRIZES:

Prizes will be described in the specific contest rules, promotional materials, website, or applicable on-air announcements. Unless otherwise stated, prizes are non-transferable and non-exchangeable, and no cash equivalent or substitution will be provided. KSYN reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. Prize values stated in promotional materials are approximate retail values unless otherwise specified. A winner may not transfer, sell, auction, or attempt to sell or auction a complimentary prize awarded by KSYN.

EVENT AND TICKET PRIZES:

KSYN is not responsible for the cancellation, postponement, rescheduling, relocation, interruption, or modification of a concert, sporting event, performance, festival, or other event for which tickets are awarded. KSYN has no obligation to reimburse a winner, provide cash compensation, or substitute another prize because of the cancellation, delay, or modification of an event unless KSYN elects to do so. Tickets are subject to the terms, conditions, restrictions, and policies established by the venue, promoter, ticket provider, artist, league, team, or other applicable third party.

TRAVEL PRIZES:

Travel prizes are subject to availability and any restrictions imposed by KSYN, contest sponsors, airlines, hotels, transportation providers, venues, or other parties involved in fulfillment. Restrictions may include blackout dates, expiration dates, age requirements, availability limitations, travel dates, and other conditions. Unless specifically included in the prize description, winners and their guests are responsible for transportation, ground transportation, meals, incidental expenses, baggage charges, gratuities, taxes, identification documents, passports, visas, insurance, and other expenses associated with accepting or using the prize. Winners and guests may be required to travel on the same itinerary and may be required to sign eligibility, liability, or publicity releases before travel. KSYN is not responsible for cancellations, delays, missed connections, changes in travel arrangements, weather, acts of nature, illness, acts of terrorism, governmental action, work stoppages, bankruptcy of a travel provider, or other circumstances beyond its control.

GIFT CARDS AND CERTIFICATES:

Gift cards and gift certificates are subject to the terms, conditions, restrictions, expiration provisions, redemption policies, location restrictions, excluded products, and other conditions imposed by the issuer. KSYN is not responsible for the loss, theft, expiration, closure of a business, or refusal to honor a gift card or certificate after it has been awarded, except as otherwise required by law.

HOW TO CLAIM PRIZE:

Winners will be selected and notified as described in the specific rules for each contest. Unless alternate arrangements are acceptable to KSYN’s promotions department, winners agree to appear at KSYN’s studios to claim the prize. KSYN’s address is 2702 East 32nd Street, Joplin, MO 64804, and prizes may only be claimed between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday (no holidays).

If a prize is mailed or delivered with the winner’s consent, the winner assumes the risk of loss or damage during delivery to the extent permitted by law.

Winners may be required to provide proof of age, government-issued photo identification, taxpayer identification information when legally required, an affidavit of eligibility, a liability release, a publicity release, and any other documentation reasonably required by KSYN or the prize provider. Failure to provide required documentation may result in forfeiture of the prize.

Unless otherwise stated in the specific contest rules, winners have thirty (30) days from the date they are notified or their name is first publicly announced to claim the prize. Failure to claim a prize within the applicable period may result in forfeiture. KSYN may award an unclaimed or forfeited prize to an alternate eligible entrant or elect not to award the prize.

TAXES AND EXPENSES:

All federal, state, and local taxes associated with a prize are the sole responsibility of the winner. KSYN will issue and file any tax reporting documents required by applicable law. Any expenses associated with accepting or using a prize that are not expressly included as part of the prize are the sole responsibility of the winner.

DISQUALIFICATION AND PENALTIES:

All entrants agree to comply with these General Contest Rules and any specific contest rules. KSYN may disqualify any entrant for violating contest rules; providing false, fraudulent, incomplete, or misleading information; tampering with the entry or winner-selection process; attempting to gain an unfair advantage; using automated or unauthorized entry methods; engaging in fraudulent activity; interfering with the operation of a contest; engaging in disruptive, threatening, harassing, illegal, or unsportsmanlike conduct; or attempting to sell or auction a complimentary prize when prohibited by these rules.

Entrants suspected of cheating, manipulating a contest, coordinating improper activity with other entrants or third parties, damaging property, interfering with KSYN’s operations, or engaging in unlawful activity may be disqualified and may be prohibited from participating in future KSYN contests. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE THE ORDINARY AND NORMAL OPERATION OF A CONTEST, TELEPHONE SYSTEM, WEBSITE, APPLICATION, OR OTHER CONTEST PLATFORM, OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, KSYN RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

PUBLICITY RELEASE:

Unless prohibited by law, participation in a contest constitutes permission for KSYN, Zimmer Radio, Inc. and contest sponsors to use an entrant’s or winner’s name, voice, biographical information, photograph, image, likeness, city of residence, contest entry, and contest-related content for advertising, promotional, programming, or publicity purposes without additional compensation.

Entrants acknowledge that contest entries and submitted materials may be displayed, broadcast, discussed, reproduced, or otherwise featured by KSYN in connection with the contest or related programming. To the extent permitted by law, entrants release KSYN and contest sponsors from claims arising from such authorized use.

ENTRANT-SUBMITTED CONTENT:

When a contest requires photographs, videos, audio recordings, essays, stories, artwork, or other entrant-created material, the entrant represents that the entrant owns or has the legal right to submit the material; that the submission does not violate another person’s copyright, trademark, privacy, publicity, or other legal rights; that the submission does not contain unlawful material; and that any individuals appearing in the submission have provided any permission legally required for its use. KSYN may disqualify submissions that it determines are inappropriate, unlawful, offensive, infringing, fraudulent, or inconsistent with the requirements or purpose of the contest. Unless otherwise stated in specific contest rules, submitted contest materials will not be returned.

PRIVACY AND COMMUNICATIONS:

Information collected in connection with a contest may be used to administer the contest, contact entrants and winners, verify eligibility, fulfill prizes, comply with legal obligations, and for other purposes described at the time of entry. Participation in a contest does not automatically constitute consent to receive marketing emails or text messages unless such consent is separately requested and provided in accordance with applicable law. Any optional marketing consent is separate from the entrant’s eligibility to participate unless otherwise permitted by law and expressly stated.

ADDITIONAL TERMS AND CONDITIONS:

These rules apply to all KSYN-sponsored contests unless modified or superseded by rules written for a specific contest, or if inapplicable to such a promotion or contest. In the event any specific contest rule conflicts with any of the general rules provided above, the specific contest rules prevail. KSYN reserves the right, in its sole discretion and to the extent permitted by law, to interpret, supplement, or modify contest rules when necessary for the fair and proper administration of a contest. KSYN shall not be responsible for any administrative errors involved in the execution of any contest. The decisions of KSYN’s Program Director or General Manager are final.

If any provision of these rules is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
